• To confirm your booking:

    Pre-payment is essential at least 24 hours prior to day of departure. Bookings are to be made via our online booking system with payment processed 1 day prior to tour departure.

    Cancellations:

    Cancellations received within 24 hours prior to departure date and no shows are subject to a 100% cancellation fee.

    Cancellations received with greater than 24 hours noticed are entitled to a full refund or travel credit. Date changes are permitted (subject to availability).

    In the unlikely event we are not able to operate a tour, due to weather conditions or unplanned operational events an alternate travel date will be offered, or a full refund processed.

    Private Charters

    Deposit Required:

    A 25% deposit at time of booking. Balance Due: 14 Days prior to day of the tour.

    Cancellations:

    Cancellations received within 14 days prior to commencement date, and no shows are subject to 100% cancellation fee.

    Cancellations received with greater than 14 days’ notice are entitled to a full refund or travel credit. Date changes are permitted (subject to availability).

    GENERAL CONDITIONS

    A customer will make their own way to the ‘starting point’ at Simsons landing, Nelson.

    Bocara Cultural Walking Tours is unable to guarantee exact finishing time and cannot be held liable for failure to make other tours or for any expenses incurred by the client as a result of the weather conditions, or other unforeseen cause.

    If for any reason the itinerary is altered, no refund is payable by the operator. Bocara Cultural Walking Tours reserves the right (without payment or compensation and whether before or after commencement of the tour) to exclude any passenger if that passenger appears likely to endanger the health or safety of themselves or others or impair the comfort of other passengers; this includes any passenger who commits any illegal act.

    Bocara Cultural Walking Tours reserves the right to change or alter your tour itinerary without prior notice due to weather, or operational requirements and would do so with full consideration of your safety and comfort. No refunds are given in these circumstances.

    Bocara Cultural Walking Tours is not responsible for any loss, damage, injury or death caused to a customer by another customer.

    Itineraries are correct at the time of publication; however slight differences may occur as we endeavour to improve our tour throughout the year. No refund is given for altered Itineraries; however, we do so with your tour satisfaction as our number one goal.

    LIABILITY

    Bocara Cultural Walking Tours accept no responsibility for any booking, contract, travel, accommodation or group tours which result in any loss, damage, accident, diversion, or theft in regard to luggage or personal belongings, and will be exempt from all liability in respect of direct or indirect consequential loss or damage, death, injury, sickness, irregularity, delay liability, and additional expenses, or inconvenience or any other event beyond its control including accident, failure of machinery or equipment, accommodation, transport, or other services.

    Our walking tours take place on Aboriginal land and share stories, language, and knowledge that have been passed down through generations. We walk with permission, and we invite you to join us with care, respect and responsibility.

    What is ICIP?

    Indigenous Cultural and Intellectual Property (ICIP) refers to the rights of Aboriginal and Torres Strait Islander peoples to protect and control their cultural knowledge, stories, language, and heritage.

    ICIP includes things like:

    • Oral stories and histories

    • Place-based knowledge

    • Art, language, songs and ceremony

    • Sacred and restricted sites

    • Cultural interpretations of the landscape

    ICIP belongs to Aboriginal people. It is shared under cultural law, not public ownership.

    What you can and can’t do

    When you come on one of our tours, you agree to follow these cultural protocols:

    ✅ Do:

    • Listen with care and ask respectful questions

    • Follow the guidance of your tour leader

    • Ask before taking photos, especially of people or culturally significant places

    • Keep shared stories private unless you have permission to share

    ❌ Don’t:

    • Use your phone or camera in restricted zones

    • Geo-tag culturally sensitive locations

    • Reproduce or publish what you learn on the tour without permission

    • Use cultural knowledge for commercial or promotional purposes

    Some areas on Country are sacred or restricted. You will be told clearly when photography or sharing is not permitted.

    This tour is run in partnership with Traditional Owners and local Elders, who have generously given permission for specific stories, language, and knowledge to be shared publicly.

    We acknowledge the Gunditjmara people as the Traditional Owners of the Country we walk on.

    We pay our respects to Elders past and present, and we thank those who have supported this work through cultural authority and guidance.

    ICIP and your booking

    When you book a tour with us, you will be asked to agree to our ICIP and Cultural Protocols as part of your Terms and Conditions. This is a condition of participation.

    We reserve the right to ask any participant to leave the tour if they do not follow cultural guidelines.
